Copyright, Takedowns and Removals

Last updated: 2026-10-27

SoupFestivals is run by Latent Software LLC, a Wyoming limited liability company, 30 N Gould St, Ste N, Sheridan, WY 82801, USA ("we", "us", "our"). This page explains how to tell us that something on SoupFestivals (the "Service", as the Terms of Service define it) infringes your rights, breaks the law or is wrong, and what we do with that request. It works with the Terms of Service and our Acceptable Use and Community Rules.

Some parts of the Service store or display information supplied by users, such as profiles, photos, tips, reviews and comments. The legal rules applicable to that information depend on the particular function and circumstances. We retain every immunity, safe harbor and defence available under applicable law. Nothing here claims protection for conduct or content outside its legal scope. Where Article 8 of Regulation (EU) 2022/2065 (the "Digital Services Act") or 17 U.S.C. § 512(m) applies, we have no general obligation to monitor the information that we store or transmit, within the scope of that provision. Other content, such as listings of festivals and businesses, recipes and articles, we publish ourselves. You can use this page for both. Removing or changing material is not an admission of anything.

1. Where to send what

What you want Send it to
A copyright notice or counter-notice [email protected], or by post (Section 2)
Remove or replace your poster, logo or photo [email protected]
Correct the credit for, or remove, a photo you took [email protected]

Whatever you send, include the exact web address (URL) of the page concerned. Without it, we may not be able to find what you mean.

If you believe that material on the Service infringes your copyright, send a written notice to our designated agent. Under 17 U.S.C. § 512(c)(3), the notice must include:

  1. your physical or electronic signature, or that of a person authorized to act for the copyright owner;
  2. identification of the copyrighted work that you say is infringed (or, if there are several works, a representative list of them);
  3. identification of the material that you say is infringing, with enough detail for us to find it, such as its exact URL;
  4. your name, postal address, telephone number and email address;
  5. a statement that you believe in good faith that the use of the material is not authorized by the copyright owner, its agent or the law; and
  6. a statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act for the owner.

Designated agent:

Latent Software LLC, Attn: DMCA Agent
30 N Gould St, Ste N, Sheridan, WY 82801, USA
Email: [email protected]

This agent is registered with the U.S. Copyright Office (designation DMCA-1077217) for Latent Software LLC and its websites, including SoupFestivals.

A notice that leaves out these elements may not be valid. For material eligible for the DMCA notice-and-takedown procedure, we respond expeditiously to substantially compliant notices by removing or disabling access as required for the applicable safe harbor, and take reasonable steps promptly to notify the affected subscriber. Where a notice contains sufficient identifying and contact information but is incomplete, we take the assistance steps required by Section 512. We may send a copy of your notice, including your contact details, to the person who posted the material, because the counter-notice process depends on it.

3. Counter-notices

If material you posted was removed or disabled because of a copyright notice, and you believe that was a mistake or a misidentification, you may send a counter-notice to the same agent. Under 17 U.S.C. § 512(g)(3), it must include:

  1. your physical or electronic signature;
  2. identification of the material that was removed or disabled, and where it appeared before (such as its URL);
  3. a statement, under penalty of perjury, that you believe in good faith that the material was removed or disabled as a result of a mistake or a misidentification;
  4. your name, postal address and telephone number; and
  5. a statement that you consent to the jurisdiction of the U.S. federal district court for the judicial district where your address is (or, if your address is outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who sent the original notice, or that person's agent.

We promptly forward a compliant counter-notice, including your contact details, to the original notifier and inform them that access will be restored after 10 business days. We restore access between 10 and 14 business days after receiving it unless our agent first receives notice of a filed court action seeking to restrain the subscriber's infringement. Material may remain unavailable on an independent lawful ground, which we explain where required.

4. False notices

A person who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, costs and attorneys' fees under 17 U.S.C. § 512(f). If you are not sure whether a use infringes your rights, for example because it may be fair use, consider getting legal advice before you send a notice.

5. Repeat infringers

We close, in appropriate circumstances, the accounts of users who repeatedly infringe other people's copyright. We may also close an account after a single serious or clear infringement.

6. Posters, logos, photos and illustrations

Posters, logos and other images. Posters, photographs, logos and other third-party works remain subject to their holders' rights. Their appearance here does not imply endorsement or give visitors permission to reuse them. Rights holders may submit a copyright notice or another rights complaint using the procedure on this page. That a work is publicly available, here or elsewhere, does not give anyone else a licence to copy it from us. If you organize a festival or run a business, or own the rights in a poster, a logo or an image, you can ask us to remove it or to replace it with a different one, and we act promptly. Email [email protected] with the page's URL, what you want us to do, and how you are connected to the festival, the business or the work. If you send a replacement, you confirm that you have the right to let us show it.

Credited photos. Some photos on the Service, such as photos of towns, are freely licensed or in the public domain. Credited works are used under their licences; credits and any required notices accompany them on the Service, and our photo credits page lists each one with its licence. If you took one of these photos and the credit is wrong, or you would like us to stop showing it, email [email protected] with the photo's page or file name. We will correct the credit or remove the photo on request.

Illustrations. Illustrations on the Service do not show any actual festival, dish or place.

You can also use the copyright process in Section 2 for any of this material.

7. Reporting illegal content (EU Digital Services Act)

To report content on the Service that you believe is illegal, email [email protected]. Under Article 16(2) of the Digital Services Act, your notice should include:

  1. a clear explanation of why you believe the content is illegal;
  2. its exact location, such as the exact URL, and any other detail we need to find it;
  3. your name and email address, unless you are reporting an offence under Articles 3 to 7 of Directive 2011/93/EU (child sexual abuse and exploitation); and
  4. a statement that you believe in good faith that the information and claims in your notice are accurate and complete.

A notice without these elements may not give us knowledge that the content is illegal. You can also use this address to report content that breaks our Acceptable Use and Community Rules.

Where the law requires, we confirm that we received your notice, tell you what we decided, and tell you how you can challenge that decision. Where we remove or restrict content or an account, and the law requires it, we give the person affected a statement of reasons. Where Article 17 of the Digital Services Act applies, it is clear and specific, is given at the latest when the restriction takes effect, and contains the information that Section 14.5 of the Terms lists. We may use automated and human means to detect, review and act on content, and to detect and act on abuse, spam and security threats. Automated protective measures may temporarily restrict access. Content-moderation complaints receive the human supervision required by applicable law. For reports other than copyright notices, we share your identity with the person affected only where it is needed to handle the report or the law requires it.

Point of contact. [email protected] is our single point of contact for authorities of the EU Member States, the European Commission and the European Board for Digital Services (Article 11 of the Digital Services Act), and for users of the Service (Article 12). You can write to us in English or Portuguese.

8. Correcting or delisting a festival, an event or a business

The information in our listings comes from publicly available information and from information that people send us. It may be incomplete, out of date or wrong, and we welcome corrections.

Corrections. If dates, the place, the price, the opening hours, the description or anything else in a listing is wrong, email [email protected] with the listing's URL, what is wrong, and, if you can, a link to an official page that shows the right information. Organizers and businesses can also send us updates this way, or through any tool that the Service gives them.

Delisting. If you organize a festival or run a business and want us to stop listing it, email [email protected] with the listing's URL, how you are connected to it, and why. We consider each request. A festival is a public event, and a business open to the public is publicly known, so we may keep listing factual information about them, such as a name, dates, opening hours and place, because people have an interest in knowing about them. We will correct anything that is wrong, and we may remove or change other material, such as a poster, a photo or a description, where that is fair.

We decide what the Service publishes. A correction or a delisting request does not give anyone control over a listing. Approved claims and business profiles work the same way (see the Terms).

9. Personal data in listings

Listings sometimes name people, such as organizers, owners or contact people, because that information is publicly available or because someone sent it to us.

If your name or other personal data appears in a listing, and you want it corrected or removed, or you object to us using it, email [email protected]. Tell us the listing's URL and what you want. We will correct errors and consider each request under the law that applies, including your rights to object and to erasure. Where we process your personal data on legitimate interests under the GDPR and you object on grounds relating to your particular situation, we stop that processing unless we demonstrate compelling legitimate grounds overriding your interests, rights and freedoms, or the processing is needed to establish, exercise or defend legal claims. We may keep factual information about a public event or a business that does not identify you. Our Privacy Policy explains your rights and how to complain to a data protection authority.

Images of children. If an image or personal data of a child or a young person under 18 appears on the Service, tell us at [email protected] with the URL, and we will remove it.

10. Trademark complaints

Names of festivals, businesses, towns, associations and municipalities appear on the Service to identify them. That does not mean that their owners are affiliated with us or endorse us.

If you own a trademark (or act for its owner) and believe it is used on the Service in a way that misleads people or infringes your rights, for example in a username, a profile, a business profile or an organization account name, email [email protected] with:

  1. the trademark, and proof that you own it or may act for its owner;
  2. the exact URL where it appears; and
  3. what you want us to do, such as correct, rename or remove.

We may ask for more information. We decide whether and how to act.

11. Impersonation complaints

If a profile, a username, an organization account or a business profile pretends to be you, your festival, your business, your association, your school or youth group, or your municipality, email [email protected] with the profile's URL (such as soupfestivals.com/@username), who you are, and why you believe it impersonates you. We may ask you to prove who you are. We may rename the username, hide the profile, withdraw a claim, or suspend or close the account, as our Acceptable Use and Community Rules say.

12. Requests from authorities

Courts, police and other authorities should send requests and orders to [email protected], in English or Portuguese. This includes orders under Articles 9 and 10 of the Digital Services Act.

We give out information about users, or remove content, in response to valid legal process under the law that applies to us. We review each request, and we may push back on a request that is unclear, too broad or not legally valid. We may tell the user concerned about a request before we disclose anything, unless the law or a court order forbids it.

13. How we handle requests

  1. We handle clear and specific requests in a timely, diligent, objective and non-arbitrary manner, and act where we decide action is warranted.
  2. We do not commit to any fixed response time. We may ask you for more information before we act.
  3. Sending us a request does not create a duty that we owe to you or to anyone else, beyond the duties that the law places on us. Nothing on this page limits those duties.
  4. If you disagree with a decision we made about your content or account, reply to the email in which we told you, or write to [email protected]. We will look at it again. Where Article 20 of the Digital Services Act applies, the complaint process in Section 14.5 of the Terms is open to affected users and to people who sent a notice. This does not affect any other right that the law gives you.

We write these documents in English, and the English text governs. We may provide translations. Where the law that protects you requires a version in your language to prevail, or requires these documents to be interpreted in your favour, that law applies. Mandatory consumer and data-protection law determines any language or interpretation requirement; a language-precedence provision does not restrict those rights. You can read and keep these documents before you accept the Terms or give us personal data.

Encontrou algo errado? Diga-nos e vamos ver. Também pode enviar-nos mensagem no Instagram, @soupfestivals
